I need to preface this post with some background on the Supreme Court. Ideologies aside, it’s clear that the conservative members of the court are extremely biased toward Donald Trump, and are willing to disregard the rules of law and precedent. Courts don’t make law, they interpret it. Congress makes laws. In the recent Trump Immunity decision the conservative members of the court created new law out of “whole cloth.” Basically, they created brand new law that specifically benefitted Trump and severely undermined democracy. It was a brilliantly stupid short-term move, with disastrous long-term consequences for the United States.
There are many reasons that the conservative members of the court would want to see Trump returned to the White House. Some of them are on the verge of retirement. As I previously posted, if Trump is elected, it will most probably cement the conservative majority on the court for at least a generation.
Picture this…
Kamala Harris wins. Easily. She wins both the popular vote and the Electoral College.
Right now, we are less than two weeks from the election, and Republicans have already prepared a mountain of lawsuits in swing states. Should Trump lose, those cases will (quickly) make their way through the courts, ultimately ending up on the steps of the Supreme Court.
The conservatives on the Supreme Court only need to disenfranchise some citizens here, and a few there, and bingo! Trump wins! These will be citizens with a legal right to vote, but due to some technicality, some “i” was not dotted correctly, or some “T” was not crossed, and their vote will be discarded. Again, these are citizens who have a right to vote, but the hoops they were made to jump through may take that right away.
In this scenario, the court will overturn the will of the people. This is how democracy ends in America.
